Lindsay Lohan Goes After Pitbull’s ‘Everything’–But Gets Nothing

Lindsay Lohan (Photo: Gilbert Carrasquillo)Sorry, Lindsay Lohan. We know you were offended by the somewhat callow use of your name in Pitbull’s 2011 hit “Give Me Everything”—but unfortunately the courts didn’t share your ire.

Lohan’s lawsuit against the hip-hop star—who rapped “So I'm tip-toein' to keep flowin'/I got it locked up like Lindsay Lohan” in the tune—was dismissed on Thursday. U.S. District Judge Denis ruled the song a protected work of art, putting the actress out of luck.

The original suit, filed last November, asserted Lohan suffered emotional distress over “an unwarranted, unauthorized, and unfavorable mention of [her] name and personality, and allusions to [her] physical and mental character.” She also claimed it violated her civil rights by using her name without permission for commercial purposes.

Pitbull (Photo: Maury Phillips)The judge responded by noting that the lyric is protected by the First Amendment as a work of art. He also ruled that the one-off use of her name was of an “isolated nature,” and therefore a weak claim.

In an additional blow for Lohan’s camp, her attorney was sanctioned and fined for “false representation to the court,” as her briefs were apparently plagiarized from newspapers, law firms and other education websites.

Not everything went poorly for Lohan in this case. Pitbull’s own legal team sought to go after the actress for filing a frivolous lawsuit; however, the judge said the action wasn’t warranted.
