Gross's line-of-sight was blocked by a platform that was erected specifically for the show. Glen Rosenberg, a guest of Gross's for the concert, told the New York Post of the show, "It would have been pretty special, had I actually been able to see it."
Ticketmaster defended the ticket locations by saying Gross had asked for the best seats available at the time of purchase. Unfortunately for Gross, the best seats were obstructed views.
Gross's lawsuit is seeking $10 million for both punitive and compensatory damages. Gross lawyer Peter Agulnick is also attempted to certify the lawsuit, which will enable others who have purchased tickets through Ticketmaster for any event and then found themselves with obstructed view seats without warning to get compensation.
