Incubus Responds To Former DJ Royalty Arbitration Claim

(6/16/03, 4 p.m. ET) -- Just about six months after former Incubus deejay Gavin Koppel filed for arbitration in regard to past royalties, the band has filed a motion with the Los Angeles County Superior Court seeking what is known as "declaratory relief," reports Rollingstone.com. By seeking declaratory relief, the band is looking to clarify its duties and rights on a 1999 royalty settlement reached with Koppel. The band also hopes for a protective order seeking to keep private the financial details of its 1999 settlement with Koppel, known then as DJ Lyfe.
Koppel filed the suit on January 16 with the American Arbitration Association, claiming the band didn't account his royalties properly or failed to pay him.
Koppel, who was replaced by current DJ Kilmore in 1999, joined the band in 1995 and performed on the band's 1995 release Fungus Amongus and the band's 1997 album, S.C.I.E.N.C.E..
