Incubus Settles Suit With Sony Music

(4/14/03, 4 p.m. ET) -- Incubus has settled its suit with Sony Music, and in return Sony has dropped its counter-suit against the band. A statement reads that they have "amicably resolved their differences," and that the two will continue to work in good faith with each other. No terms were confirmed by the band's publicist, but several published reports have Incubus being paid around $8 million for its next album, and $2.5 million for the following two releases. The reports also state that Sony has an option to renew for a fourth album. Sony will eat approximately $3 million in promotional costs.

Incubus filed complaint February 6 in the Los Angeles County Superior Court in Santa Monica seeking to end its contract with Immortal and Sony Music invoking the "Olivia de Havilland clause," or section 2855 of the California Labor Code. Sony counter-sued for "breach of contract" a few days later.

Incubus and longtime bassist Dirk Lance parted ways earlier this month. No explanation for the split was available, but the band has named Ben Kenney, the former guitarist of the Roots, to take his place.
